You retain full ownership of the financial data you upload to PoktWise. By uploading data, you grant us a limited, non-exclusive licence to store and process it solely for the purpose of providing the Service to you. We do not claim any rights over your financial information.
You are solely responsible for the accuracy, legality, and completeness of all data you upload. You represent and warrant that you have the right to upload such data and that doing so does not violate any applicable law or the rights of any third party. PoktWise bears no responsibility for errors, omissions, or inaccuracies in data you provide. Please refer to our Privacy Policy for details on how we store and protect your data.
The AI assistant feature provides automated, conversational analysis of data you have uploaded. AI-generated responses are not financial advice, tax advice, investment advice, or legal advice of any kind. They are informational and organisational summaries only and may contain errors, omissions, or inaccuracies. PoktWise expressly disclaims all liability for any action you take — or fail to take — based on AI-generated output. Always consult a qualified, licensed professional for financial, tax, legal, or investment decisions.

The PoktWise application, its design, branding, and code (excluding the data you upload) are owned by us or our licensors. Nothing in these Terms transfers intellectual property rights to you. You may not copy, modify, or redistribute the application or its branding without our written permission.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. We do not warrant that the Service will be error-free or free of security vulnerabilities, although we make reasonable efforts to ensure both.
PoktWise makes no warranty, representation, or guarantee regarding the accuracy, timeliness, or completeness of any financial analysis, categorisation, AI-generated output, or other information produced by the Service. All output is provided for informational and organisational purposes only. You use the Service and rely on its output entirely at your own risk. PoktWise is not a bank, financial institution, investment adviser, tax adviser, or regulated financial services provider.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POKTWISE, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO:
PoktWise's total aggregate liability to you for all claims arising out of or in connection with the Service shall not exceed USD $10 (ten US dollars).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
You agree to defend, indemnify, and hold harmless PoktWise and its operators, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
You may delete your account at any time from Settings → Data Management. Upon deletion, all your personal and financial data is permanently removed within 30 days.
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on severity. In cases of suspected fraud or illegal activity, we may terminate immediately and report to the relevant authorities. PoktWise shall have no liability to you for any termination or suspension of your account carried out in accordance with these Terms.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for claims that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively by binding individual arbitration administered by a recognised arbitration body under its applicable rules, rather than in court. The arbitration will be conducted in English.
Class action waiver: You and PoktWise each agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
California residents: Notwithstanding the above, if you are a California resident, nothing in this section limits rights or remedies you may have under California consumer protection laws, including the California Consumer Legal Remedies Act (CLRA), the Consumers Legal Remedies Act, or the Unfair Competition Law (UCL), to the extent such rights cannot be waived by contract.
You may opt out of the arbitration agreement within 30 days of first accepting these Terms by emailing support@poktwise.com with the subject line “Arbitration Opt-Out”. Opting out will not affect your right to use the Service.
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. To the extent court proceedings are permitted under Section 13, you consent to the exclusive jurisdiction of the state and federal courts located in California. Notwithstanding the foregoing, mandatory consumer protection laws applicable in your state or jurisdiction shall not be superseded by this choice of law.
California (CA): Under the California Consumer Legal Remedies Act and the California Unfair Competition Law, certain provisions of these Terms may not apply to you. California residents may have additional rights not described here. Contact us at support@poktwise.com for details. Pursuant to California Civil Code § 1789.3, the complaint assistance unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. New Jersey (NJ): The limitation of liability and disclaimer of warranties provisions in these Terms do not apply to New Jersey residents to the extent New Jersey law prohibits such limitations.
New York (NY): Nothing in these Terms limits any rights you may have under New York General Business Law § 349 (deceptive acts and practices) or § 350 (false advertising).
All other US states: If applicable mandatory consumer protection laws in your state limit any provision of these Terms, that provision is modified only to the minimum extent necessary to comply with such law.
PoktWise shall not be liable for any failure or delay in performing its obligations under these Terms caused by circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, internet or infrastructure outages, cyberattacks, governmental actions, or pandemic events.
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PoktWise regarding the Service and supersede all prior agreements, representations, and understandings.
